IPINAAAKYAT na ng piskalya sa hukuman ang reklamong isinampa ng isang pulis sa isang Chinese student na nanaboy ng taho sa kanya dahil lamang sa pagbabawal dito na ipasok ang dalang taho sa Boni Station ng Metro Rail Transit Line 3 (MRT-3) sa Mandaluyong City, matapos itong makitaan ng probable cause.

Sa isang pahinang resolusyon na inilabas ng Mandaluyong City Prosecutor´s Office nitong Pebrero 11, inirekomenda ni City Assistant City Prosecutor Leynard Dumlao ang pagsasampa ng kasong paglabag sa Article 148 ng Revised Penal Code o Direct Assault on Agent of Person in Authority na inihain ni PO1 William Cristobal laban sa Chinese student na si Zhang Jiale, 23.

Inapbrubahan naman ito ni City Prosecutor Bernabe Augustos Solis.

“Probable exists to indict respondent with direct assault.  In the crime of direct assault against an agent of person in authority, the assault and force employed must be serious in character as to indicate respondent’s determination to defy the law and its representative at all hazards. Indeed, the throwing of the cup of ‘taho’ to complainant, then in uniform is considered deliberate and serious defiance to a police officer who was performing his duties at that time.  It is offensive both by legal and moral norm considering that there was no provocation on the part of the police officer.  Simply put, respondent’s unwarranted act is an abrasive affront against an officer in uniform representing a national institution,”  nakasaad pa sa resolusyon.

Nabatid na ibinasura naman ng prosecutor ang reklamong disobedience, gayundin ang unjust vexation laban sa Chinese national dahil resulta na lang umano ito ng ginawang direct assault sa police officer.

“Viewed herefrom, it is recommended that the foregoing Resolution be approved indicating respondent Jiale Zhang for Direct Assault to an Agent of Person in Authority under Article 148 of the Revised Penal code and the attached information therefore be filed in court,” bahagi pa ng resolusyon.

Wala namang tinukoy na halaga ng piyansa ang piskalya para sa paglaya ng dayuhan, ngunit ayon kay NCRPO chief P/Director Guillermo Eleazar, ang direct assault ay may katapat na piyansa na P12,000.

Nauna rito, nag-viral sa social media ang larawang kuha ng pagsaboy ni Zhang ng kanyang dalang taho kay PO1 Cristobal sa Boni Station ng MRT 3 nang hindi sya papasukin at sinabihang ubusin muna ang pagkain dahil sa paghihigpit nang pagdadala ng likido at mga pagkain sa loob ng MRT station.

Inaresto si Zhang at habang isinusulat ang balitang ito ay patuloy pa rin siyang nakadetine sa Mandaluyong City Prosecutor’s Office.

Inaasahan namang anumang oras ay makakalaya na ito sa sandaling payagan itong makapaglagak ng piyansa.
